Company files “Plan B” reverse domain name hijacking case.
Insurance company Cake Insure, Inc. attempted to reverse hijack the domain name everpeak.com, a UDRP panelist has ruled.
The company has an insurance business called EverPeak that uses the domain name EverPeakInsurance.com.
That business was named well after everpeak.com was registered.
Cake Insure tried to buy the domain through a GoDaddy broker, but the broker was unable to get a response from the registrant.
So Cake Insure filed a UDRP, even though it would be impossible to show the domain was registered in bad faith before its brand existed.
To get around this issue, the insurance company tried to argue that the domain was renewed in bad faith.
Panelist Alan L. Limbury said this was a classic “Plan B” case in which a company files a UDRP after failing to buy a domain name.
