
GigaLaw’s quarterly report sheds light on what’s happening in UDRP decisions.
Getting a complete picture of UDRP cases is difficult because there are five approved UDRP dispute providers. Just because numbers are trending one way with a particular provider doesn’t mean it’s true of all of the providers combined. Thankfully, there’s a source that combines the data from all five into an easy-to-consume format.
Through his law firm, GigaLaw, Doug Isenberg publishes a quarterly Domain Dispute Digest that aggregates data from the five providers, which provides a clear picture of what’s going on in UDRP.
Doug Isenberg knows UDRP. Not only does he represent complainants, but he’s also a panelist with all of the UDRP providers.
Here are some interesting takeaways from his Q2 report, which covers decisions published in April, May, and June:
- Overall decisions decreased 2.6% year over year to 2,077.
- The number of domains covered in those decisions dropped 39.0% year over year to 3,015.
- Of all decisions, 94.2% were rendered in favor of the complainant.
- WIPO continues to be the most popular venue, with 1,179 decisions in the quarter. Forum (National Arbitration Forum) had 613, and Czech Arbitration Court had 227.
- Twenty decisions during the quarter were reverse domain name hijacking. That’s 1.3% of all decisions.
- After .com, .shop, .net and .org are the most common gTLDs in UDRP cases.
- The transfer rate at Forum was the lowest of the major UDRP providers (see image at top).
